2. Exemption Status

PMVPlay operates as a Secondary Producer and/or may qualify for certain exemptions under 18 U.S.C. § 2257 and 28 C.F.R. § 75.1(c). We are a user-generated content platform where third-party users upload content. As such:

PMVPlay does not produce or commission the creation of the content hosted on our platform.
Content is uploaded by independent users who retain ownership and responsibility for their uploads.
We do not hire, contract with, or manage performers.
We do not control or direct the creation of the content.

3. Content Producer Requirements

All users who upload content to PMVPlay are considered Primary Producers and must:

Maintain records pursuant to 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for all performers in their content.
Certify that all individuals appearing in their content are 18 years of age or older at the time of production.
Retain copies of government-issued identification for all performers.
Make these records available for inspection by the U.S. Department of Justice upon request.

For Content Uploaders

By uploading content to PMVPlay, you represent and warrant that:

You are the producer of the content or have obtained all necessary rights.
You maintain all required records under 18 U.S.C. § 2257.
All individuals depicted in sexually explicit conduct are 18 years of age or older.
You will make your records available to PMVPlay and government authorities upon request.

4. Custodian of Records

For content uploaded by users, the Primary Producer (uploader) is the custodian of records and must maintain the required documentation. The location of these records must be disclosed to PMVPlay upon request.

5. Enforcement and Compliance

PMVPlay takes compliance with federal record-keeping laws extremely seriously:

Zero Tolerance for Underage Content: Any content featuring individuals under 18 years of age is strictly prohibited and will be immediately removed.
Account Termination: Users who upload content featuring minors will have their accounts immediately and permanently terminated.
Law Enforcement Cooperation: We will report any suspected child exploitation material to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement agencies.
Content Review: We employ both automated and manual systems to detect and remove prohibited content.
User Reporting: Users can report suspected violations through our platform.

6. Age Verification Certification

All users who upload content to PMVPlay must complete an age verification certification process which includes:

Confirming they are 18 years of age or older.
Certifying that all performers in their content are 18 years of age or older.
Agreeing to maintain required records under 18 U.S.C. § 2257.
Acknowledging that violations may result in criminal prosecution.
